Yesterday, #POTUS signed a new #ExecutiveOrder entitled. “Proclamation Suspending Entry of Immigrants Who Present Risk to the U.S. Labor Market During the Economic Recovery Following the COVID-19 Outbreak.” A lot of confusion exists regarding who this new order effects and how. Here is what you need to know.
What does it do?
The new EO temporarily bans certain classes of immigrants from entering the U.S.
How long will the ban last?
The ban starts today and will last for 60 days. It can be extended for an additional 30 days before it expires.
Who is banned from entering the United States?
Immigrants who are currently:
Outside the U.S.;
Do not have a valid immigrant visa, AND;
Do not have a valid travel document (such as a transportation letter, boarding foil, or advance parole document).
Does it apply to all classes of immigrants?
No.
Who does it NOT apply to?
The EO does NOT apply to:
Anyone currently in the U.S.
Applicants for Adjustment of Status
Anyone seeking entry on a nonimmigrant visa
Anyone entering the U.S. to apply for asylum, withholding of removal or withholding under the Convention Against Torture
Spouses of U.S. Citizens
Children of U.S. Citizens under age 21
Medical Professionals & Researchers working on #COVID-19 (and their Spouse unmarried Children under age 21)
Adoptees under the IR-4 or IH-4 visa categories
Members of the U.S. Armed Forms and their Spouse and Children
Anyone whose entry would further important U.S. law enforcement objectives
Special Immigrant Visas (SI or SQ classification) and their Spouse and Children
Anyone whose entry would be in the national interest
Are there any waivers?
The EO does not specify any particular waivers.
If I am currently in the U.S., can I still apply for adjustment of status?
If you are currently in the U.S. and are eligible, you can still apply for adjustment of status. This has no effect on that process.
